This privacy notice describes how we collect, use and store personal information about you during and after your business relationship with us, in accordance with the General Data Protection Regulation (EU 2016/679) (GDPR) and the Data Protection Act 2018.

Able Health Care Limited is a “data controller”. This means that we are responsible for deciding how we hold and use and store personal information about you. We are required under the GDPR to notify you of the information contained in this privacy notice.

THE KIND OF INFORMATION WE COLLECT AND HOLD ABOUT YOU

As part of Liberty Lodge and Fern Lodge (incorporating Liberty Lodge Independent School) , we will collect, store and use personal data from third party providers.

Personal data will be limited to:

  • Full name
  • Address & postcode of staff or carer / guardian
  • Telephone number
  • Email address – personal and business
  • CCTV footage
  • Educational background of young people

We will also collect, store and use the following “special categories” of sensitive personal data:

  • Ethnicity of staff and young people
  • Health needs / medical history of young people
  • LAC status & assessment history of young people

HOW WE WILL USE INFORMATION ABOUT YOU

We will only use your personal information in the ways the law allows. Most commonly, we will use your personal information in the following circumstances:

  1. Where we need to perform the contract we have entered into with you to provide you with services.
  2. Where we seek your views on the services that we provide.
  3. Where we need to notify you of changes to our services.
  4. Where we send you information about other services that you have specifically requested from us.

We need all the categories of information detailed in the list above primarily to allow us to perform our contract with you and to enable us to comply with legal and regulatory obligations. Some of the above grounds for processing will overlap and there may be several grounds which justify our use of your personal information.

Data retention

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. RIGHTS OF ACCESS, CORRECTION, ERASURE & RESTRICTION

It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes during your working relationship with us.

Your Rights:

Subject Access Request – this enables you to receive a copy of the personal information we hold about you. To action this request, please contact us at info@libertylodge.com. We require a suitable form of identification and under normal circumstances, we will supply this to you within one calendar month of the date we receive suitable proof of ID.  No fee is payable however we have the right to impose a fee if the request is deemed to be excessive or repetitive.

Request Correction – this enables you to have any incomplete or inaccurate information we hold about you corrected.

Request Erasure – this enables you to delete or remove personal information when there is no good reason for us to continue processing it.

Object to Processing – in certain circumstances, you have the right to request we suspend the processing of your data.

Request the Transfer – you have the right to request the transfer of your personal data to a third party.

Right to Withdraw Consent – where we rely on consent to process your data, you have the right to withdraw this at any time, without giving reason. To withdraw your consent, please contact info@libertylodge.com. Once received, we will not process your data for the reasons you have agreed to, unless we have another legal basis for doing so.

Right to complain – you have the right to complain at any time to the Information Commissioners’ Office (ICO) regarding data protection issues.
